Bega Bucks Rewards Offer –Terms & Conditions

  1. The Bega Bucks Rewards Offer (Offer) is offered by BDD Australia Pty Ltd (ABN 68 083 019 390) of 737 Bourke Street, Docklands, Vic (Bega).  The Offer is governed by these terms and conditions.  Participation in the Offer is deemed as acceptance of these terms and conditions.
  2. The Offer commences 26 June 2023 and continues until such time Bega decides, at its discretion, to terminate or amend the Offer (Offer Period).  Any termination or amendment of the Offer or Offer Period will be notified by Bega..
  3. The Offer is only open to Bega’s independent grocery customers operating in Australia who: 
    a) are classified as either Single Site Operators (SSO) or Multiple Site Operators (MSO);
    b) have not entered into ongoing trading terms or a separate written agreement in relation to the supply of goods with Bega;
    c) have been invited by Bega to participate inthe Offer; and
    d) have returned a duly signed Electronic Funds Transfer (EFT) Authorisation and Sign Up Form (EFT Form) to Bega,
    (the Participating Outlets)
  4. The Offer compromises the Bega Bucks Platinum Rewards Offer (Platinum Offer) and the Bega Bucks Gold Rewards Offer (Gold Offer).  Further details of the Platinum Offer and Gold Offer are set out below.. 
  5. Bega will determine, in its absolute discretion, the eligibility criteria for participation in the Platinum Offer or the Gold Offer.  Participating Outlets will be notified by Bega as to whether they are eligible to participate in the Platinum Offer or the Gold Offer.  Participating Outlets will not be able to participate in the Platinum Offer and the Gold Offer at the same time.

Platinum Offer

  1. Any Participating Outlet who Bega determines, in its absolute discretion, is eligible to participate in the Platinum Offer (Platinum Participating Outlets) will be entitled to receive a $500 cash reward from Bega for each quarter during the Offer Period (ie up to a total annual cash reward of $2,000) that they are able to meet the following requirements of the Platinum Offer to Bega’s satisfactio
    a) hold 100% of the Core Product Range, as dictated by Bega, throughout the quarter;
    b) hold the agreed share of shelf space for the Core Product Range, as dictated by Bega, throughout the quarter; and
    c) accept any allocation of New Product Developments (NPD) from Bega and hold such allocation for a period of 13 weeks,
    (the Platinum Offer Requirements). 
  1. Cash rewards under the Platinum Offer will be paid by Bega to the bank account nominated by compliant Platinum Participating Outlets in their respective EFT Form after the end of each quarter during the Offer Period. 
  2. Any Platinum Participating Outlet who meets the Platinum Offer Requirements to Bega’s satisfaction for four (4) consecutive quarters over a period of 12 months starting on 26 June in any given year and ending on 25 June in the following year will be entitled to receive an additional bonus cash reward of $500 from Bega (and, for clarity, such a compliant Platinum Participating Outlet would be entitled to receive a maximum annual cash reward of $2,500 from Bega). An additional bonus cash reward is only payable by Bega to a compliant Platinum Participating Outlet once per annum following the anniversary start date of the Offer Period (ie 26 June). 
  3. Bega may monitor a Platinum Participating Outlet’s compliance with the Platinum Offer Requirements in any way Bega considers appropriate. Platinum Participating Outlets must fully co-operate with Bega and comply with any direction or request made by Bega in the conduct of the Platinum Offer.  Bega reserves the right to refuse making payment of a cash reward to any Platinum Participating Outlet who has not met one or more of the Platinum Offer Requirements to Bega’s satisfaction.  If at any time a Platinum Participating Outlet’s customer account with Bega is in arrears by more than 30 days, Bega may deduct or set off any amount owing by Bega to such Platinum Participating Outlet under these terms and conditions (whether or not due for payment) against any amount due for payment by such Platinum Participating Outlet to Bega.
  4. Any Platinum Participating Outlet may withdraw from the Platinum Offer at any time during the Offer Period. In the event a Platinum Participating Outlet withdraws from the Platinum Offer, that Platinum Participating Outlet will be deemed to have forfeited all rights to claim any unpaid cash reward or other compensation from Bega and no substitute cash reward, credit, compensation or payment will be offered by Bega. Following receipt of a written request, Bega may, in its absolute discretion, allow a Platinum Participating Outlet who has withdrawn from the Platinum Offer to opt back into the Platinum Offer on any terms Bega considers appropriate.

Gold Offer

  1. Any Participating Outlet who Bega determines, in its absolute discretion, is eligible to participate in the Gold Offer (Gold Participating Outlets) will be entitled to receive a $400 cash reward from Bega for each quarter during the Offer Period (ie up to a total annual cash reward of $1,600) that they are able to meet the following requirements of the Gold Offer to Bega’s satisfaction:
    a) hold 80% of the Core Product Range, as dictated by Bega, throughout the quarter;
    b) hold the agreed share of shelf space for the Core Product Range, as dictated by Bega, throughout the quarter; and
    c) accept any allocation of New Product Developments (NPD) from Bega and hold such allocation for a period of 13 weeks,

(the Gold Offer Requirements). 

  1. Cash rewards under the Gold Offer will be paid by Bega to the bank account nominated by compliant Gold Participating Outlets in their respective EFT Form after the end of each quarter during the Offer Period.
  2. Any Gold Participating Outlet who meets the Gold Offer Requirements to Bega’s satisfaction for four (4) consecutive quarters over a period of 12 months starting on 26 June in any given year and ending on 25 June in the following year will be entitled to receive an additional bonus cash reward of $400 from Bega (and, for clarity, such a compliant Gold Participating Outlet would be entitled to receive a maximum annual cash reward of $2,000 from Bega). An additional bonus cash reward is only payable by Bega to a compliant Gold Participating Outlet once per annum following the anniversary start date of the Offer Period (ie 26 June).
  3. Bega may monitor a Gold Participating Outlet’s compliance with the Gold Offer Requirements in any way Bega considers appropriate. Gold Participating Outlets must fully co-operate with Bega and comply with any direction or request made by Bega in the conduct of the Gold Offer.  Bega reserves the right to refuse making payment of a cash reward to any Gold Participating Outlet who has not met one or more of the Gold Offer Requirements to Bega’s satisfaction. Following receipt of a written request, Bega may, in its absolute discretion, allow a Gold Participating Outlet who has withdrawn from the Gold Offer to opt back into the Gold Offer on any terms Bega considers appropriate.

General

  1. To the maximum extent permitted by law, Bega and its related bodies corporate are not, and will not be, liable in contract, in tort (including negligence), under any statute or otherwise for, or in respect of, any direct or indirect loss, costs, fees or damages that any Participating Outlet incurs or is liable for in connection with the Offer.  In addition, Bega is not liable for any acts or omissions of the owners, management, agents, contractors or employees of Participating Outlets. Bega accepts no responsibility for any error that leads to incorrect bank account details being recorded in Bega’s payment system or for any associated losses incurred by Participating Outlets.
  2. Bega may, in its absolute discretion, remove a Participating Outlet from the Offer if the Participating Outlet is (in Bega’s opinion) behaving in a manner which is aggressive, disruptive or may diminish Bega’s good name and reputation or Bega’s products and brands, or is contrary to law or is otherwise inappropriate. Bega also reserves the right to disqualify a Participating Outlet from the Offer in the event of non-compliance with these terms and conditions. In the event that there is a dispute concerning the Offer, Bega will resolve the dispute in direct consultation with the Participating Outlet. If the dispute cannot be resolved, Bega’s decision will be final and binding.
  3. A Participating Outlet cannot transfer or assign any of their rights, obligations or entitlements under the Offer to any other person(s).
  4. Bega accepts no responsibility for any tax or financial implications that may arise from the Offer. Participating Outlets should seek their own independent advice in this regard.
  5. Bega is not obliged to reimburse Participating Outlets for any costs or expenses that they have incurred in relation to the Offer.
  6. These terms and conditions are governed by the laws of Victoria, Australia and the parties submit to the non-exclusive jurisdiction of its courts.
  7. Bega may collect personal information in order to conduct the Offer and may disclose such information to third parties (including agents, contractors, service providers and prize suppliers) for that purpose.  Bega may also use personal information for marketing and promotional purposes.  See Bega’s privacy policy at https://www.begagroup.com.au/privacy-policy/ for full details.
  8. Bega reserves the right, at any time and for any reason whatsoever, to terminate, suspend or amend the Offer or otherwise vary these terms and conditions without notice.
